Monona Man Arrested After Taking Photos in Residence Hall Restroom

On Friday, December 15 at approximately 2:45 p.m., the UW-Madison Police Department responded to Witte Residence Hall for a report of a man who was taking photos in a first floor women’s restroom. A female victim reported to UWPD that the man, Justin T. Fahy, 27, of Monona, slipped his phone under the restroom stall and took photographs of her. Fahy, who identified himself as a Special Agent at the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) stated it was a misunderstanding and he mistakenly went into the wrong restroom.
Search warrants were obtained to inspect Fahy’s phone and security footage from inside Witte Hall was reviewed. It was determined that Fahy was in the women’s restroom for at least 14 minutes. In addition, Fahy’s phone had been recently restored to a backup point from earlier this year, leading UWPD investigators to believe he was likely trying to delete evidence.
On Tuesday, December 19, the UW-Madison Police Department arrested Fahy – he was booked into the Dane County Jail on tentative charges of attempting to take photos depicting nudity (felony) and disorderly conduct. Fahy has also been formally banned from the UW-Madison campus.
